FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Lead Judgment): This appeal is against the decision of the High Court of Rivers State, Port Harcourt Judicial Division CORAM: C. A. OKIRIE, J., (Hereinafter referred to as the Court below) delivered on the 20th day of June, 2019. The decision appealed against is at pages 426– 427 of the record of appeal, wherein the Court delivered its decision against the Appellant.
Dissatisfied with that decision, the Appellant, on the 3rd day of July, 2019, filed a notice of appeal containing three (3) grounds. The notice of appeal is at pages 428– 432 of the record of appeal.
BRIEF FACTS
The Respondents, as 1st to 3rd Claimants, instituted the suit leading to this appeal against the Appellant as Defendant by a writ of summons together with a statement of claim and all other Court processes on the 29th day of August, 2018.
