HELEN MORONKEJI OGUNWUMIJU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the ruling of the Honourable Justice D. D. Abutu sitting at the Federal High Court Lagos on the 16th day of July, 2007.
The facts that led to this appeal are as follows:
The Plaintiff, now the Appellant commenced an action on the 2nd of August 2006 against the Defendants now Respondents in their respective official capacity as agents and officials of the Government of the Federal Republic of Nigeria claiming as follows:
1. A DECLARATION that the Defendants' non-service on the Plaintiff of:
a. Defendant's intention to revoke Plaintiffs Right of Occupancy on the subject land measuring 4157.06sq mtrs. and registered as No. 93 at page 93 in Volume 1791 of the Registry of Lands, Lagos, Lagos State (and thereafter),
