RULING
One Mansan Kakraba Dansou died on the 12th day of November, 2014 in Cotonou, in the Republic of Benin. The said Mansan Kakraba Dansou was alleged to have died possessed of 0.20 acre plot of land situate and lying at Adjiringano, Accra.
Plaintiff who claims to be beneficiary of the estate of Mansan Kakraba Dansou which estate includes the said plot of land sued Defendants and sought for declaration of title to the said plot of land, among other reliefs.
The only disclosed capacity by which Plaintiff instituted the action is expressed in paragraph 2 of the Amended Statement of Claim filed on 4th July, 2016. And it is that the Plaintiff is a beneficiary of the estate of the late Mansan Kakraba Dansou.
