JUDGMENT
INTRODUCTION
On the 27th day of November 2024 the plaintiff herein filed a writ in the registry of this court. In an amended writ of Summons and statement of claim filed pursuant to the leave of court, Kwabena Adu-Kusi and Samuel Kwaku Gyampo, in their capacities as executors of the estate of the late Mabel Brenya Gyampo, brought a claim against the Anglican Diocese of Tema, Anglican Church of Ghana (1st Defendant) and TDC Ghana Limited (2nd Defendant) concerning ownership and possession of a parcel of land known as Property Number VC/MKT/A/122, Community 1, Tema.
THE PLAINTIFFS’ CASE
The plaintiffs contend that the property was originally acquired by Madam Gladys Adjetey Brenya in 2013 through a lease granted by TDC Ghana Limited, the statutory body responsible for managing and leasing lands on behalf of the Government of Ghana in Tema and its surrounding communities.
