JUDGMENT

ASUMAN-ADU, J.

On 14th May 2009, the Plaintiff issued out Writ of Summons against the Defendant and the Co-Defendant claiming as follows:

a. General damages arising from the negligence of the Defendant and Co-Defendant.

b. Costs.

On 18th May 2009 both the Defendant and the Co-Defendant were served with the Writ of Summons with the accompanying statement of claim. The Defendant entered appearance on 27th May 2009 but the Co-Defendant did not enter appearance. Neither of them filed statement of defence so on 19th October 2009 the Plaintiff took interlocutory judgment in default of appearance against Co-Defendant and in default of defence against the Defendant. On 15th February, 2010 he gave evidence to prove his damages. On 18th March 2010 the Medical Officer who examined him gave evidence on the extent of injuries sustained by the Plaintiff and on 12th May 2010, the Plaintiff filed amended Writ of Summons and Statement of Claim pursuant to leave granted by the court on 4th May 2010…
