OGUNTADE, JCA (Delivering the Lead Judgment) : The respondent was the plaintiff before the Lagos High Court in suit No. LD/3697/99 and had claimed against the appellant as the defendant some reliefs. The reliefs as stated in paragraph 20 of the plaintiff’s statement of claim filed on 22/12/ 2000 read:
“(a) A declaration that the office at No. 37 Bornu Crescent, Apapa, Lagos. The computers, furniture, typewriters and all other assets contained therein, the vehicles comprising a Daewoo Racer, Honda Accord and Jeep, the goods made up of 12,229 cartons of confectionaries and 26 generator sets formerly located in plaintiff’s warehouse at Apapa Railway compound and all monies contained in the bank account No. 141044914 at Ecobank Nigeria Plc.
