ALI ABUBAKAR BABANDI GUMEL, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the Plateau State High Court, sitting in Jos, delivered on the 7th February, 2005 in Suit No. PLD/J.401/1997. The Appellants were the plaintiffs at the trial Court. In a joint Statement of claim dated and filed on 10th November, 1998 they sought for the following reliefs. They are:-
(a) A declaration that the Deed of Assignment dated the 3th of August, 1991 between Alhaji Shuaibu Ibrahim Nuhu and Mrs. Martha Adegboye constitute a valid agreement for the sale of the parcel of land covered by C of O No. BP 1918.
(b) A declaration that the consent of the military Administrator Plateau state to assign the C of O No. 1918 from Alhaji Shuaibu Ibrahim Nuhu to Air Vice Marchal Mouktar Mohammed dated the 4th of January, 1995 is null and void.
(c) A declaration that the purported Deed of assignment dated the 11th day of May 1995 between Alhaji Shauibu Ibrahim Nuhu and Air Vice Marshal…
