OMOLEYE JCA (Delivering the Lead Judgment): This is an appeal againstthe judgment of the National Assembly/Governorship and Legislative Houses Election Tribunal holden at Lafia, Nasarawa State delivered on 21 August 2007.

The brief background facts of this matter are that, in the 14 April 2007 general election, the Peoples’ Democratic Party (PDP) sponsored the appellant, while the Labour Party (LP) sponsored the 1st respondent, as candidates for the election into the Nasarawa State House of Assembly to represent the Wamba Constituency. After the election, the appellant was alleged to have scored the highest number of votes, that is, 10,298 and declared the winner. The 1st respondent and his party, Labour Party, the 2nd respondent in this appeal were dissatisfied with the outcome of ,the election.
