ITA GEORGE MBABA, J.C.A. (Delivering the Leading Judgment)
This appeal is against the decision of the High Court of Kano State in Suit No. K/586/2010, delivered on 27th January, 2011, by Hon. Justice Wada Abubakar Omar, wherein the Learned trial Judge entered judgment for the Plaintiff against the Defendant, in the sum of Thirteen Million, Seven Hundred and Fifty Thousand Naira (N13,750,000) only, with interest thereon, from the date of the judgment, at the rate of 10% per annum, until the liquidation of the judgment debt, being the money Defendant owed the Plaintiff, as per their last agreement, dated 1/7/2010.
At the lower Court, the Respondent, as Plaintiff, had taken an Undefended List action before the Court, for recovery of the sum of Thirteen Million, Seven Hundred and Fifty Thousand Naira (N13,750,000) only, said to be debt owed by Appellant, and for interest, thereon, at the rate of 10% per annum.
