FREDERICK OZIAKPONO OHO, J.C.A. (Delivering the Leading Judgment): This is an appeal against the decision of the Customary Court of Appeal sitting at the Yola Judicial Division (hereinafter referred to as: “the Court below”), delivered on the 20th March, 2023; wherein the Court below delivered its judgment against the Appellant and in favour of the Respondent. Dissatisfied with the decision of the Court below, the Appellant has brought his appeal before this Court. The Respondent, as Plaintiff before the Court below took out a Writ of Summons against Bakari Magaji and Musa Ladan as 1st and 2nd Defendants respectively in Suit No. UACG/CV/FI/66/2016, wherein he prayed the trial Court for the following reliefs;
a. A Declaration that the land in dispute belongs to the Plaintiff, which he inherited from his grandfather, Bayandi.
b. A Declaration vesting title to the land on the Plaintiff.
