OKUNOLA, J.C.A. (Delivering the Leading Ruling): This application was filed by way of motion on notice on 8th November, 1996 for the following orders:-
(i)Extension of time within which the applicant is to bring an application for stay of execution of the Judgment of the Lower Court dated 6th May, 1995.
(ii)Staying the execution of the judgment delivered by Hon. Justice O.O. Adesina on 6th May, 1995 in Suit No. 1/681/95 on terms fairer and better than that imposed by the Lower Court pending the hearing and determination of the appeal in this case.
On 28th October, 1997 when this application came up for hearing before us Mr. S.T.A. Raji appeared for the appellant/applicant while Mr. Uche Akalugo appeared for the respondent. When this application came up for hearing, both learned counsel for the parties addressed the court in respect of the application dated and filed on 8th October, 1996.
