ISAIAH OLUFEMI AKEJU, J.C.A. (Delivering the Lead Ruling): The Appellants/Applicants filed a Motion on Notice on 1/11/13 praying this court for an order substituting United Bank for Africa Plc for Trade Bank Plc as the 1st respondent in this appeal on the grounds adumbrated in the motion as follows:
"(a) The transaction that led to the dispute between the Appellant/Applicant and the 1st Respondent took place sometime in 1996 when the 1st Respondent was known as TRADE BANK PLC.
(b) Presently the 1st (sic) has been taken over by United Bank for African (sic) Plc due to the reconstructing programmes of the Nigeria Deposit Insurance Corporation (NDIC) (2nd Respondent) in Banking and other Financial Institutions in the Country.
(c) United Bank for Africa has taken over all the assets and liabilities of the 1st Respondent herein because the 1st Respondent is no longer in existence.
