YARGATA BYENCHIT NIMPAR, JCA (Delivering the Leading Judgment): This appeal is against the Ruling of the Lagos State High Court delivered by HON. JUSTICE ADEBIYI on the 30th April, 2013 dismissing the suit brought by the Appellants for being statute barred. The Appellants filed a writ before the Court below claiming as follows:
1. A Declaration that the claimants are entitled to the statutory right of occupancy over all that piece of land situate, lying and being at Omole Town, Ikeja, Lagos State of Nigeria, measuring approximately 14 acres.
2. The sum of Twenty Million Naira (N20, 000,000.00) being special and general damages suffered by the claimants as a result of the acts of trespass committed by the defendants themselves, jointly and severally with their agents destroying the claimants' economic trees crops and preventing them from doing any work on the land in dispute.
