GALINJE JCA (Delivering the Lead Judgment): By a statement ofclaim dated 3 April 1995, the appellant herein claimed at the Lagos High Court the following relief:
N40,000.00 (fortythousand naira) being the agreed contribution of the 1st and 2nd defendants to secure the release of land and property situate at 2A, Abiodun Street, Mushin, pursuantto suit No.ID/1137/93 between A lhaji (Chief) W.A Irawo and Anor v. Alhaja Rafatu Lawal and/or Declaration granting the right to the plaintiff to manage and collect rents in respect of the 4 rooms on the top floor of the property situate at 2A, Abiodun Street, Mushin, for 3 years commencing from 1 November 1994 to 31 October 1997 in satisfaction of her contribution to securethe land and properties all situate at 2A, Abiodun Street, Mushin, upon which an action was filed against the plaintiff.
