SANGA JCA: (Delivering the Lead Ruling): Before the High Court of Justice, Bayelsa State, Brass Judicial Division, the appellant/applicant together with one Mr. Coker Adike (now deceased) were the defendants/counterclaimants while the respondents were the claimants. The claimants claimed for the following reliefs before the said lower court:
A declaration that the Obe’s family sale of part of their Abam Bus land to the plaintiffs vide the separate dee d of conve yanc e da te d 8 Oc tobe r, 2001 respectively is valid and subsisting. A declaration of Statutory Right of Occupancy over the parcels of lands as reflected in the survey plans attached to the deed of conveyance dated 8 October, 2001 respectively.
A declaration that the sale or purported sale of plaintiffs’ land as covered in the deed of conveyance to 3rd parties by the defendants either jointly or severally is unlawful, illegal and void. Five hundred thousand naira as damages for trespass.
