MOHAMMED LAWAL GARBA, J.C.A. (Delivering the Leading Judgment): In a Ruling delivered on the 30th March, 2009 by the Federal High Court, sitting at Lagos in Respondent's Suit No: FHC/UCS/158/2008, the Appellant's application to set aside the ex-parte order of interim injunction made against it, was refused. The ex-parte order was made on 4th September, 2008 while the Appellant's application to set it aside was filed on the 10th of December, 2008 and when it was refused in the Ruling dated 30th March, 2009, the Appellant filed their application dated the 29th April, 2009 and filed on 24th May, 2009 before the Federal High Court (Lower Court) by which it prayed for reliefs as follows: -
1. An order of Court extending time within which to bring this application.
2. An order of Court granting leave to the Defendant/Applicant to appeal against the decision/ruling of the Honourable Court dated 30th March, 2009.
