MOHAMMED, JCA (Delivering the Lead Judgment): On or about 3/ 11/2000, the appellants were arrested separately by the Police along with others on the allegation that they belong to a gang of armed robbers that operated at Sayan village in Sabuwa Local Government Area of Katsina State. After their arrest, the appellants along with other suspects arrested with them, were taken to Sabuwa Police Station where they were detained. On 21/11/2000, the appellants with two other suspects were arraigned before a Chief Magistrate Court Katsina and charged with four others still at large with the offence of armed robbery punishable under the Robbery and Fire Arms (Special Provisions) Act Cap. 398, Laws of the Federation of Nigeria, 1990 and remanded in prison custody since then.
