T.O. AWOTOYE, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of Hon. Justice Iche Ndu (Chief Judge) of Rivers State High Court delivered on 5/5/2008.
The claimant had taken out a writ of summons against the defendants.
The endorsement on the writ of summons read thus:
"1) One million five hundred and thirty thousand Eight hundred and three (1,530,803.00) only being and representing the contract value of goods supplied by the claimant to the defendant's for which the defendants have refused and/or neglected to pay.
2) N30,000.00 (Thirty Thousand Naira) only being and representing a refundable Registration fee paid by the claimant to the defendant.
3) 12% interest per annum on the above stated sums from October 2005 when the money became due and payable till judgment is delivered in this matter.
4) 4% interest per annum on the judgment sum from day judgment is given till the judgment sum is liquidated."
