I.M.M. SAULAWA, JCA (Delivering the Leading Judgment): This is an appeal against the judgment of the Lagos State High Court, Lagos Judicial Division, which was delivered by the Hon. Justice A. Olateru-Olagbegi on December 15, 2009 in Suit No. LD/4585/95. By the said judgment, the lower court dismissed reliefs 1 and 3 and awarded relief 2 of the Respondent's Amended Statement of Claim. The lower court accordingly awarded the sum of FF35,990.00 as special damages in favour of the Respondent, against the Appellant.
Not unnaturally, the Appellant was dissatisfied with the said judgment. Thus, with the leave of this court, duly granted on December 7, 2010, the Appellant filed the notice of appeal thereof on December 8, 2010, which was predicated upon three grounds of appeal.
