JUDGMENT

AYEBI, JA

1. The plaintiff/appellant is a farmer resident at Apitisu No.1 on Bekwai Stool Land. 1st defendant respondent is a traditional priestess resident at Bekwai-Fawoman. The 2nd defendant/respondent is the son of the 1st defendant/respondent. He is also a farmer resident at Apitisu No.1.

2. The subject-matter of the suit is a piece of land which the plaintiff/respondent stated is situated at Cheburo-Apitisu and bounded by the properties of Kojo Amoako, Mame Gyamfua, Komfo Serwaah and Yaw Fosu. It is plaintiff’s case that her granduncles by name Adgya and Adade broke a virgin forest and demarcated a portion of it to her grandmother, Maame Dufie. Her mother Afua Amankwaa succeeded her grandmother and when her mother died, she and her siblings have cultivated the land with foodstuffs and cocoa for over forty years without any disturbance from any quarters. She said since all her siblings are dead she is the sole owner of the land.
