JAMILU YAMMAMA TUKUR, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of Lagos State in Charge No: ID/191C/12 delivered on 3rd August, 2012 by Honourable Justice L.A. Okunnu, wherein the Appellant was found guilty of the offence of stealing contrary to Section 390 of the Criminal Code Law, Cap C17, Vol 2, Laws of Lagos State, 2003.

Upon the illness of one B.C. Madiebo, founder and chairman of B.C. Madiebo and Co., an incorporated Insurance Brokerage Firm, the Appellant was appointed by Mrs. Mabel Madiebo, the Vice-Chairman to run the affairs of the company. The activities of the Appellant while in charge of the company, led to the lodging of a petition dated 8th December, 2009 with the Economic and Financial Crimes Commission.
