FABIYI, JCA (Delivering the Lead Judgment): This is an appeal against the ruling of Kasim, J., siting at the Federal High Court, Enugu on 29th September, 1997.

For an adequate appraisal of the issues canvassed in this appeal, it is apt to reproduce paragraphs 2, 5, 6, and 7 of the plaintiffs’ claim, which read as follows:

“2. The first defendant is the parent Union duly incorporated and registered under part of the operative Companies and Allied Matters Decree No 1 of 1990; with headquarters at Ibadan, Oyo State of Nigeria. The 2nd defendant is the General Secretary of Union charged with the day-to-day overall administration of the Union, while the 3rd defendant is the Enugu State Secretary of the Union resident at Umuabi, Udi.

5. By letter dated 20th March, 1996 from the Union headquarters addressed simultaneously to the 2nd defendant and the said Messrs. Oside and Ohagwu, the Union in apparent recognition of Oside/Ohagwu persistence in interfering with the functions of the plaintif…
