LADAN-TSAMIYA JCA (Delivering the Lead Judgment): This isan appeal by the two appellants against the decision of the National Assembly/ Governorship and Legislative Houses Election petition Tribunal (herein referred to as the lower tribunal) holden in Awka, Anambra State, in petition No. EPT/NAE/HR/29/07.
The relevant facts in this appeal are that, the petitioners at the lower tribunal, filed a joint petition containing two grounds, challenging that the 1st respondent’s election into the House of Representative for Anambra West and East Constituency was void for reasons of:
Corrupt practice,
Substantial non-compliance with theprovisions of the Electoral A
Act, 2006.
They prayed for an order nullifying the election and prayed further, that fresh election be conducted by the 2nd - 55th respondents pursuant to paragraph 27 of the 1st Schedule to the Electoral Act, 2006. The petition was supported by a total of 55 witnesses’ statements on oath.
