ABUBAKAR SADIQ UMAR, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Federal High Court, Lagos Judicial Division delivered on 13th November, 2017 by Hon. Justice Hadiza R. Shagari wherein the trial Court granted the Respondent’s reliefs against the Appellant.
By its further statement of claim dated 11th July, 2013 and filed on 12th July, 2013, the Respondent sought the following reliefs against the Appellant:
“i) The sum of N6,465,750.00 (Six Million, Four Hundred and Sixty Five Naira (sic) Seven Hundred and Fifty Naira) being special damages for negligence and/or breach of contract by the Defendants, in respect of the demurrage charge paid to APM Terminals at Apapa Port as demurrage charge.
ii) The sum of N8,382,180.00 (Eight Million, Three Hundred and Eighty Two Thousand One Hundred and Eighty Naira) being special damages for negligence and/or breach of contract by the Defendants, in respect of the demurrage charge paid to the Defendants.
