BITRUS GYARAZAMA SANGA, J.C.A. (Delivering the Leading Judgment): This appeal emanates from the Judgment of BOLOU M. UGO J., (now JCA) of High Court of Justice Bayelsa State Yenagoa Judicial Division delivered on 21st May, 2013. By an endorsed Writ of Summons and Statement of Claim dated 28/2/2012 the Appellants sued the Respondents in a representative capacity as Claimants and Defendants respectively, in Suit No. YHC/25/2012 claiming for the following reliefs: -
