JAMES GAMBO ABUNDAGA, JCA (Delivering the Leading Judgment): This is an appeal against the judgment of high court of Kaduna State in charge No. KDH/KAD/102C/2014 delivered on 16/10/2017, Coram: Hon Justice Hannatu A.L. Balogun (as he then was), whereof the appellant and his co-accused one Bitrus Baba were sentenced to death for offences of criminal conspiracy to commit armed robbery, and armed robbery, and for aiding and abetting the offence of armed robbery. The appellant felt aggrieved by this conviction and decided to appeal to this court.
Having sought and obtained an order of extension of time to appeal out of time, he proceeded to file his notice of appeal on 2/2/2022 (Pages 96-100 of the record of appeal). The judgment is contained on pages 80-95 of the record of appeal.
