JEGA JCA (Delivering the Lead Judgment): This is an appeal against the ruling/judgment of honourable Justice TaniY. Hassan of the Kano State High Court delivered on the 11th day of March, 2003 wherein judgment was entered for the respondent under the undefended list procedure against the appellants in the sum of N58,604,562.32k being the outstanding amount against the appellants’account as at 29th August, 2002.
The facts of this case as can be seen from the totality of the records presented before this court inclusive of the filed briefs are as follows:-
By a writ of summons dated 5th day of September 2002 taken under the undefended list procedure the respondent claimed as follows against the appellants.
The sum of N58,604,562.32k beingthe sum outstanding against the defendants’accounts as at the 29th August, 2002.
(b) Bank interest at the rate of 35% per annum from the 30th August, 2002 till date of judgment. 10%court interest from the date of judgment till the satisfaction of same.
