DANLAMI ZAMA SENCHI, JCA: This Appeal is against the final decision of the Federal High Court, Minna, in Suit No. FHC/MN/CS/91/2022 delivered on 21st day of March, 2023 Coram: AMINU GARBA, J.
The Appellant (as Plaintiff at the trial Court) commenced this suit against the Respondents (as Defendants) vide an originating summons filed on the 22nd of December, 2022 seeking the determination of the following questions:-
A. Whether by the community effect of sections 83 (1) , 84 (5) (C) (i) and (ii) 84 (8) (12) and (13) of the Electoral Act 2022; Article 20 (iii) and (iv) (a) of the Constitution of the All Progressive Congress and the All progressives Congress Guideline for the Nomination of candidates for the 2023 General Elections, Political Appointees and those holding Political offices are not ineligible to vote as delegates in the Court Ordered Primary Election of the 1st Defendant for Bosso Constituency of the Niger State House of Assembly held on the 10th December 2022.
