(DELIVERED BY CHIDI NWAOMA UWA, JCA) The Respondent as plaintiff at the Federal High Court Jalingo, Taraba State (hereafter referred to as the Trial Court) initiated the suit that gave rise to this appeal vide an originating summons in which three questions were sought for determination and if determined in his favour twelve (12) reliefs were prayed for. The issues are as follows:
1.“WHETHER, the Plaintiff’s appointment as the Managing Director/Chief Executive Officer of the 3rd Defendant was not validly renewed by virtue of the 3rd Defendant’s Board of Director’s resolution dated 19th October, 2017 and the 3rd Defendant’s letter of renewal of appointment dated 19th October, 2017 wherein the Board of Directors resolved and approved the renewal of the Plaintiff’s appointment as Managing Director/Chief Executive Officer of the 3rd Defendant for another fixed term of five years.
