UWABUNKEONYE ONWOSI, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the High Court of Kebbi State sitting at Zuru Judicial Division delivered by Hon. Justice Stephen M. Kibo, on the 9th Day of February, 2024 in Suit No. KB/ZR/HC/5CV/2021. Wherein the Trial Court entered judgment in favour of the Claimant/Respondent.

Dissatisfied with the decision of the Court below, the Appellant filed an Amended Notice of Appeal on the 12th day of November, 2025, in which the Appellant set out three (3) grounds of appeal.

BRIEF STATEMENT OF FACTS

The Respondent commenced this action before the Kebbi State High Court, Zuru Judicial Division, by a Writ of Summons filed on 7 December 2021, seeking, inter alia, a declaration of customary right of occupancy over the disputed land and damages for trespass (see pages 1–2 of the Record of Appeal).
