ITA GEORGE MBABA, J.C.A. (Delivering the Leading Judgment): This Appeal is against the decision of the Plateau State High Court in Suit No. PLD/J/236M/2020, delivered by Hon. Justice Bakfur, on 1/9/2020, whereof the learned Trial Judge struck out the fundamental rights claim of the Applicant (now Appellant) for want of jurisdiction.

At the lower Court, Appellant had sought the enforcement of his fundamental rights against the Respondents, pursuant to Fundamental Rights (Enforcement Procedure) Rules 2009, alleging that his rights to dignity, liberty and freedom of movement, as enshrined in Sections 34, 35, 41 and 46 of the Constitution of the Federal Republic of Nigeria, 1999, as amended, were violated.
