ORJI-ABADUA, J.C.A. (Delivering the Leading Judgment): This appeal was lodged against the pronouncement made by the National Assembly Election/Governorship and Legislative Houses Election Tribunal, on the 23rd January, 2008 dismissing the Election Petition No. NA/HR/EPT/KTS/441 2007, filed by the appellants on the 21st May, 2007 at the tribunal.


The 1st appellant as a candidate of All Nigeria Peoples Party, contested the seat for House of Representative for Bindawa/Mani Federal Constituency during the general election conducted by the 3rd respondent in the country in April, 2007.

Unfortunately, the 1st appellant lost but, the 1st respondent was returned and declared the winner of the said election. The appellant was very uncomfortable with the results declared by the 3rd respondent, that he proceeded to the lower tribunal and initiated proceedings in May, 2007, by filing a petition challenging the said results.
