JUDGEMENT
The Plaintiffs on 7th July 2015 issued a Writ of Summons and Statement of Claim against the Defendants for the following reliefs:
a. The 1st Plaintiff claims against the Defendants jointly and severally for a declaration of title to that parcel of land described in Paragraph 5 of the statement of Claim.
b. The 2nd Plaintiff claims against the Defendants jointly and severally for a declaration of title to that parcel of land described in Paragraph 6 of the Statement of Claim.
c. Each Plaintiff claims against the Defendants jointly and severally:
i. Damages for trespass;
ii. Recovery of Possession and
iii. Order of perpetual injunction restraining the defendants whether by themselves, agents, servants, assigns and workmen from having any dealings with or on the said land.
The Defendants were served by substituted service of the application for default judgment but they failed or refused to attend court and so judgment was entered against them. Hearing notice was served o…
