BIOBELE ABRAHAM GEORGEWILL, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Ruling of the High Court of Lagos State, Coram: H.O.A. Abiru J., in Suit No. ID/777M/2009: Mr. I. T. Mbadike (carrying business under the name and style of Nomex Engineering Services) and Ors. v. Lagos Int. Trade Fair Complex Management Board and Ors, delivered on 1/6/2010, in which the Appellants Suit filed under the Fundamental Rights (Enforcement Procedure) Rules 2009, was struck out for being incompetent.
The Appellants were pissed with the judgment and had appealed against the said judgment to this Court vide a Notice of Appeal filed on 22/6/2010 on two Grounds of appeal at pages 269 - 272 of the Record of Appeal. The Record of Appeal was duly transmitted to this Court. The appellants' brief was filed on 17/9/2010. The 2nd Respondent's brief was filed on 25/10/2010. The 1st and 3rd Respondents did not file any brief.
