TOM SHAIBU YAKUBU, J.C.A. (Delivering the Leading Judgment): The respondents, being the plaintiffs at the Anambra State High Court of Justice, holden at Onitsha, had taken out a writ of summons, under the undefended list proceedings, on 8th October, 2012 and claimed the following reliefs against the appellant, to wit:
(1) An order of Court compelling the Defendant to pay over to the Plaintiffs the sum of N42, 000.00 (forty Two Thousand naira) being the rent for one store (AK32) he occupies at No. 1 Kano Street, Onitsha, for the period of one year, that is from 1st January, 2012 to 31st December, 2012.
(2) An order of the Court for the Defendant to pay the Plaintiffs the sum of N42,000 (Forty Two Thousand Naira) per annum for the use and occupation of the aforementioned store in his possession at No. 1 Kano Street, Onitsha from 1st January, 2013 to the date of judgment in this suit.
(3) Interest at the rate of 10% (Ten Percent) on the rent per annum till the judgment sum is paid.
