OGUNBIYI JSC (DELIVERING THE LEAD RULING): The application herein is brought by the appellant/applicant praying for the court’s order in terms of the following reliefs:

“1. An order of this honourable court staying further proceedings in charge No. FHC/ABJ/CR./05/ 2015. Federal Republic of Nigeria v. Olisa Metuh and Anor. before his lordship Hon. Justice O. E. Abang sitting at the Federal High Court, holden at Abuja (F.C.T.) pending the hearing and determination of the appeal lodged by the appellant/applicant against the judgment of the Court of Appeal delivered on 24 May 2016 in the said case wherein his lordships dismissed a no- case submission made by the appellant/applicant, the said appeal having been set down for hearing by this court for 2 November 2017.

Or in the alternative: An order of this honourable court abridging the time within which the appeal may be heard to the date of hearing of this application or any other date in March 2016, the appeal being ripe for hearing.
