MOHAMMED MUSTAPHA, JCA (Delivering the Leading Judgement): This appeal is against the decision of the Federal High Court Abuja, delivered on the 1st December, 2022 in suit No FHC/ABJ/877/2022.

Facts in brief:

The appellant and the 2nd respondent, together with others were aspirants in the primary election conducted by the 1st respondent to nominate its flag bearer for the Benue state Governorship in the 2023 general election.

Appellant is aggrieved, because he felt the 1st respondent did not conduct the election in accordance with its constitution and guidelines, the requirements of the Electoral Act and the 3rd respondent’s regulations and guidelines for political party operations, 2022, as a result of which he sought the following reliefs:
