EKO JCA (Delivering the Lead Judgment): This is an appeal against the decision of the Rivers State High Court (coram: M.D. Goodhead, J.) delivered on 3 November 2000. The notice of appeal signed by O.C.J.
Okocha SAN, was dated and filed on 15 December 2000. The appeal complains against: That part of the judgment/decision whereby the learned trial Judge held that the plaintiff was not afforded a fair hearing before his dismissal by the defendant, and thereupon adjudged that the plaintiff was entitled to salaries and benefits from 29 July 1997 (the date of his suspension from duty) to 26 January 1998 (the date of his dismissal) and three (3) months’ salaries and benefits in lieu of notice of termination of his employment.
