TIJJANI ABUBAKAR, J.C.A. (Delivering the Leading Judgment): This is an appeal against the judgment of the Medical and Dental Practitioners Disciplinary Tribunal, sitting in Lagos (Before Shima K. Gyoh, chairman; Dr. I. A. Agaldo; Dr. M. F. Amaegbe; Dr. I. N. Dan Gana; Dr. A. O. Oni and Dr. S. O. Jeboda) delivered on the 26th day of September 2007 in Charge No.MDPTDT/33/2006, wherein the Appellant was suspended from medical practice for six (6) months.

The facts leading to the proceedings at the Tribunal are as follows:

One Mrs. Florence Abatan (now deceased), a 37-year-old housewife was admitted on the 13th day of February, 2004 into the Maitama General Hospital and was subsequently delivered of a baby girl on the 14th day of February, 2004 at about 4:26am through a caesarian section and Bilateral Tubal Ligation (BTL).
