PHILOMENA MBUA EKPE, J.C.A. (Delivering the Leading Judgment): This appeal is against the judgment of the Edo State High Court sitting in Benin City delivered by Hon. Justice F.O. Akinbami on the 23rd day of February, 2010 wherein the learned trial Judge gave judgment in favour of the Respondent (who was the claimant) in Suit No. B/27/2017.

The facts of the case briefly stated are as follows:

The Respondent, by a Writ of summons against the Appellant through an ex-parte motion under the undefended list procedure filed on the 19th January, 2010 prayed for the following reliefs:

An order for the payment of the sum of N3,195,784.94 (three million, one hundred and ninety five thousand seven hundred and eighty four naira, ninety four kobo) only, being the outstanding amount owed the Respondent from the contract sum entered into between the Respondent and Appellant on the part of the Appellant vide the form of payment certificate dated 25th day of May, 2007.
