JUDGMENT
The Plaintiff sued out a writ of summons and statement of claim against her son for the reliefs of
1. An order that H/No D94/10 her matrimonial home be removed from the will.
2. Perpetual Injunction restraining the Defendant from claiming the said matrimonial home on the basis of the will.
3. Plaintiff to be declared the owner of her house in perpetuity.
The Defendant resisted the claim and filed an Amended Statement of Defence on 2nd November 2016 and counterclaimed for the reliefs of:
i. An order for leave to the Court to cancel the letters of administration granted the Plaintiff in respect of the estate of the testator.
ii. A further order praying the Honourable Court to allow the last will of the late Edward Mensah Lawson to be admitted to probate.
iii. An order declaring that the will be strictly applied in the distribution of the estate of the testator.
iv. An order declaring that the will be strictly applied in the distribution of the estate.
