UGOCHUKWU ANTHONY OGAKWU, JCA (Delivering the Leading Judgement): This appeal is against the decision of the High Court of Gombe State in CHARGE NO. GM/73C/2015 wherein it convicted the Appellant and his co-accused person for the offences charged. The Charge against the Appellant is as follows:

COUNT 1

That you (1) Mohammed Sani and (2) Musa Mohammed on or about 6th of April 2014 at Arawa/Mallam Inna quarters Gombe in the Gombe metropolis within the jurisdiction of this court, agreed to do an illegal act to wit: cause grievous hurt. And the same act was done in pursuance of the agreement, you attacked and inflicted serious injuries on one Ibrahim Sani and Wujuri Asilale. You thereby committed an offence under section 97 of the Penal Code Law and triable by this court.
