MUHAMMAD, J.C.A (Delivering the Leading Judgment): The Nassarawa State High Court of Justice holden at Keffi, and presided over by Maina, J., refused and dismissed an application for extension of time within which the appellant would file a criminal appeal against the Judgment of the Chief Magistrate's Court, Keffi. The allegation contained in the First Information Report (FIR) filed at the Chief Magistrate's Court, Keffi against the appellant as an accused person, was "Driving without due care and attention" contrary to Section 21 of the Road Traffic Law. The accused denied the allegation. The respondent as prosecution called five witnesses after which the Chief Magistrate ruled that a prima facie case of driving a vehicle without due care and attention was established against the appellant. The Chief Magistrate accordingly proceeded to charge the appellant. In his defence the appellant called three witnesses. At the end of hearing, the Chief Magistrate found the appellant guilt…
