ABBA BELLO MOHAMMED, JCA (Delivering the Leading Judgment): This is an appeal against the judgment of the High Court of the Federal Capital Territory, Abuja (the trial court), coram: Hon. Justice M.A Nasir, delivered on the 28th of September, 2017. Before the trial court, the Appellant, as Plaintiff, instituted an action against the Respondents vide Writ of Summons filed on 9th April, 2014, wherein he sought for the following reliefs:
A declaration that the Plaintiff is entitled to House 26, 34 Crescent Gwarimpa Estate as original occupier having purchased same in consideration of the sum of N7,400,000.00 (Seven Million Four Hundred Thousand Naira) only pursuant to a letter of offer dated 10th August, 2005 issued by the 1st and 2nd Defendants.
A declaration that the 1st and 2nd Defendants having waived the compliance with terms of the letter of offer dated 10th August, 2005 as to mode of payment cannot assign House 26, 34 Crescent Gwarimpa Estate Abuja to the 3rd Defendant.
