JEGA JCA (Delivering the Lead Judgment): This is an appeal againstthe judgment of the Kaduna State High Court of Justice presided over by Hon. Justice JamesAbiriyi in suit No. KDH/KAD/645/99 wherein he entered judgment on the undefended list against the appellant and the 2nd and 3rd respondents on the 7thApril, 2000 inthe sumof N2,148,189.95k(two million, one hundred and forty eight thousand, one hundred and eighty nine naira, ninety five kobo) only in favour of the 1st respondent. The appellant and the 2nd and 3rd respondents are also to pay interest on the said judgment sum to the appellant at the rate of 12% from 1st July 1999 to the date of judgment and interest thereafter at the rate of 10% until the entire judgment sum is fully liquidated. The appellant is not satisfied with the judgment of the lower A court and as a result has appealed to this court by a notice of appeal filed on 4/3/2000 containingthree grounds of appeal.
