ELFRIEDA OLUWAYEMISI WILLIAMS-DAWODU, J.C.A. (Delivering the Leading Judgment): This is an appeal against the Judgment of the Borno State High Court delivered on March 27th 2014, which set aside the Ruling of the Borno State Rent Tribunal of March 13th 2013 and entered judgment in favour of the Respondent (the Appellant at the Court below).

As gleaned from the printed Record before this Court, the Appellant herein, (the Respondent at the Court below), bought No. 12 Shehu Sanda Kyari Crescent GRA Maiduguri, from one Hajiya Amina Adamu on 28/5/12.

After change of ownership, the Respondent, who was tenant to the said Hajiya continued to occupy the premises and failed to vacate same even after service of notices to that effect on him. The Appellant therefore, went before the Borno State Rent Tribunal in Suit No. MRT/021/2013 for the recovery of vacant possession of the property.
