OGUNTADE, J.C.A. (Delivering the Leading Judgment): In suit No. FHC/L/CP/342/90 before the Federal High Court, Lagos the appellant as the applicant commenced proceedings against the respondents under the fundamental rights procedure pursuant to Order 1 rule 2(2) and 2(3) and Order 4 of the fundamental rights enforcement rules. The reliefs he claimed were these:

"(i) Declaration that the arrest and false imprisonment of


the Chief Andrew Monye on 8th March, 1996 by the Presidential Task Force on Trade Malpractices at the instance of F.S.B International Bank Plc is illegal and unconstitutional.

(ii)an order of injunction restraining the Presidential Task Force on Trade Malpractices from arresting, detaining Chief Andrew Monye on the complaint of F.S.B. International Bank Pic on a case of debt recovery.

(iii)N5 Million damages against the F.S.B. International Bank Pic for unlawful arrest and false imprisonment of Chief Andrew Monye on 8th March, 1996."
