OMAGE JCA (Delivering the Lead Judgment): This is an appeal A against the decision of Hon. Justice G. O. Shoremi sitting at Ijebu Igbo High Court Ogun State delivered on 14th day of December 2002, by which the appellant, Rasaki Moshood was convicted and sentenced to death for the murder of one Iyabo Layide said to have taken place on 24th November, 1998 at Iseje village, Ijebu Igbo. The case of the prosecution in the High Court, Ijebu Igbo is that on 23/11/98, the accused person went to the house of the deceased Iyabo Layide to invite Iyabo to his farm in order for the latter, Iyabo to buy the kolanuts of Rasaki Moshood. The 3rd prosecution witness, who said he was a co-tenant of the deceased at Olokuta village, said he was chatting with the deceased when she was alive, at the time when the accused person went to their house to invite the deceased to gowith him to buy kolanuts at Iseje village.
