YARGATA BYENCHIT NIMPAR, J.C.A. (Delivering the Leading Judgment): This appeal is against the part judgment/ruling of the Lagos State High Court delivered on the 13th of January, 2010 Coram Hon. Justice Olateru-Olagbegi wherein part judgment was entered in favour of the Respondent in the sum of ₦7,400,000.00 (Seven Million Four Hundred Thousand Naira Only) allegedly on admission. Dissatisfied with the decision, the Appellants filed a Notice of Appeal on the 9th February, 2010 wherein it set out 3 grounds of appeal.

The facts leading to this appeal in brief are that the 1st and 2nd Appellants, owners of a property situate at No. 308 Ikorodu road, Anthony Village offered their property for sale through the Respondent. The Respondent got a buyer but negotiations broke down. After about a year, the proposed buyer negotiated directly with the Appellants and bought the property without the knowledge of the Respondent.
