DANLAMI ZAMA SENCHI, JCA (Delivering the Leading Judgment): This is an appeal against the judgment of the Federal High Court in suit No. FHC/ABJ/CS/1319/2021 delivered on the 13th day of April, 2022 by A.R MOHAMMED, J.
The Respondent(as Plaintiff) approached the Trial Court vide an originating summons dated and filed on 28th day of October, 2021 seeking the determination of the following questions:-
Whether, upon the failure of the 2nd Defendant to meet up with the deadline fixed by the 1st Defendant for the submission of nomination form being the 1st day of October, 2021, pursuant to the approved Guideline for the conduct of congresses, the 2nd Defendant is qualified to contest in an election organized by the 1st Defendant in accordance with the approved guidelines and time table?
If the above question is negative, whether the Plaintiff would not be declared as the duly qualified and elected Chairman of the Peoples Democratic Party, Ebonyi State Chapter.
